1. Retreat Activities

I understand that my retreat may include lodging in a shared or private residence, meals, yoga or other gentle movement, meditation, sound baths, group discussions and sharing circles, ceremonies, use of a hot tub, sauna and fire pit, transportation provided or arranged by Rose Waters, free time, and other similar retreat, wellness, educational, or recreational activities (“Retreat Activities”).

Retreat Activities are not medical care, psychotherapy, diagnosis, or treatment.

Psilocybin preparation, administration, and integration services are governed by separate Rose Waters client agreements, informed-consent documents, and applicable Oregon requirements.

2. Voluntary Participation and Assumption of Risk

I voluntarily choose to participate in the Retreat Activities. I understand that retreat participation involves inherent and other risks associated with lodging in an unfamiliar residence; use of amenities such as the hot tub, sauna, and fire pit; yoga, movement, meditation, sound baths, and other wellness activities; meals; group activities and shared spaces; and transportation.

These risks may include physical injury, illness, emotional discomfort, or loss of or damage to personal property.

I knowingly and voluntarily accept the risks associated with my participation in the Retreat Activities. I am responsible for deciding whether I am able to safely participate in each optional activity and agree to follow reasonable safety instructions and communicate any concern that may affect my ability to participate safely.

3. Transportation

Rose Waters may provide or arrange transportation during the Retreat, including transportation between the retreat lodging and the Rose Waters service center.

I understand that ordinary risks are associated with motor vehicle travel and agree to follow reasonable transportation safety instructions.

Nothing in this Agreement releases or waives claims relating to the operation or use of a motor vehicle.

4. Travel Arrangements and Travel Insurance

I understand that I am responsible for making and managing my own travel arrangements to and from the Retreat, including airfare, lodging outside of the Retreat, ground transportation, and other travel-related expenses. Retreat dates, schedules, and activities may occasionally need to be changed, postponed, or canceled due to circumstances beyond Rose Waters’ control. I understand that Rose Waters is not responsible for non-refundable airfare, lodging, transportation, or other travel expenses I incur in connection with the Retreat.

I am encouraged to consider purchasing travel insurance that provides coverage for trip cancellation, trip interruption, travel delays, and other covered travel-related losses. I understand that travel insurance policies vary and that I am responsible for reviewing the terms, conditions, exclusions, and covered reasons under any policy I purchase, including whether the policy provides coverage if a retreat is canceled, postponed, or rescheduled.

Travel insurance is optional, and Rose Waters does not guarantee that any particular insurance policy will provide coverage for Retreat-related losses.

5. Emergency Assistance

If Rose Waters reasonably believes that I need emergency medical assistance, I authorize Rose Waters to contact emergency responders and assist in arranging emergency transportation when reasonably necessary.

Rose Waters does not provide emergency medical care. I understand that I am responsible for costs associated with emergency evaluation, transportation, treatment, hospitalization, or follow-up care.

6. Participant Conduct and Confidentiality

I agree to treat other participants, staff, facilitators, and contractors respectfully and to follow reasonable retreat, lodging, transportation, and safety rules.

Because participants may share personal or sensitive information during the Retreat, I agree not to disclose another participant’s personal experiences or identifying information without that person's permission.

I understand that Rose Waters will encourage participants to respect one another's privacy but cannot guarantee that another participant will maintain confidentiality.

Rose Waters may limit or end my participation in an activity or in the Retreat if Rose Waters reasonably believes my conduct presents a safety concern or materially disrupts the Retreat. If my participation is limited or ended for these reasons, I understand that I will not be entitled to a refund or reimbursement of Retreat fees.

7. Release of Liability

I UNDERSTAND THAT THIS SECTION AFFECTS MY LEGAL RIGHTS.

To the fullest extent permitted by Oregon law, I release and waive claims against Rose Waters Sanctuary LLC and its members, managers, employees, independent contractors, facilitators, retreat staff, agents, and volunteers (“Released Parties”) for personal injury, illness, emotional distress, death, or property loss or damage arising from or related to my participation in the Retreat Activities, to the extent such claims result from the ordinary negligence of a Released Party.

This release does not apply to claims relating to the operation or use of a motor vehicle.

This release also does not apply to liability that cannot lawfully be waived, including liability resulting from gross negligence, reckless conduct, or intentional misconduct.

8. Personal Property

I am responsible for my personal belongings during the Retreat. To the fullest extent permitted by law, Rose Waters is not responsible for loss, theft, or damage to personal property unless caused by conduct for which liability cannot legally be waived.

9. Oregon Law and Severability

This Agreement is governed by Oregon law. If any portion of this Agreement is determined to be unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

ACKNOWLEDGMENT

I HAVE READ THIS AGREEMENT AND UNDERSTAND THAT PARTICIPATION IN THE RETREAT INVOLVES RISKS. I UNDERSTAND THAT THIS AGREEMENT INCLUDES AN ASSUMPTION OF RISK AND A RELEASE OF CERTAIN CLAIMS, INCLUDING CERTAIN CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF ROSE WATERS AND THE OTHER RELEASED PARTIES. I AM SIGNING THIS AGREEMENT VOLUNTARILY.
